CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA

Pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data (“Law”), this Clarification Text has been prepared in order to inform natural persons (“Relevant Person”) about the collection, processing, storage, protection and destruction processes, means and purposes of their Personal Data, their rights under the Law and the ways to exercise these rights in cases where DOĞUŞ YENİ GİRİŞİMLER VE PROJELERİ ANONİM ŞİRKETİ has the title of data controller as the owner of this Website.

1.   Which Personal Data Do We Process?

 

The following personal data may be processed within the scope of your relationship with DYG;

 

  • Identity Information: Name, surname, date of birth, place of birth, Turkish ID number or foreign ID number, identity card number and identity card series (if you are using an old type ID card), nationality information, birth registration sample (if required).
  • Contact Information: Telephone number, e-mail, province, district and address of residence.
  • Customer Transaction Data: Support center records, receipt information, request/complaint information, lost/stolen and notice notification, information about the transactions you perform on the DYG website, including buy/sell orders/transactions, evaluation information.
  • Data on Transaction Security: IP address, hardware model, device operating system and version, device type, device ID, user transaction records, website access logs and log records.
  • Legal Action Information: Correspondence with judicial authorities, information on lawsuit/execution files in case of dispute, signature.
  • Other Personal Data: Profession information, signature circular (if you are a legal entity user authorized).
  • Bank Information: IBAN, Account No. etc.

2.   Why We Process Your Personal Data?

 

As the Data Controller, we may process your personal data for the following purposes:

  • Negotiation, conclusion and performance of a contract,
  • Provision of products and services,
  • Customization of existing products and services according to demands; updating and improving existing products and services due to customer needs, legal and technical developments,
  • User registration to systems, especially for existing products and services,
  • Providing call center and remote support services; monitoring the number and content of calls,
  • To advertise new or existing products, services and campaigns; to carry out sales and marketing activities,

  • Transportation organization of company employees, tracking of company pool vehicles,
  • Creating attendance records in case employees participate in an organization on behalf of the company,
  • Participation of employees in trainings and creation of records of the certificates they receive,
  • Keeping and monitoring visitor records,
  • Ensuring the internal and environmental security of the Company and the security of the Website and Applications,

  • Creating a personal data inventory,
  • To evaluate and respond to all kinds of questions, requests, suggestions, complaints, applications, including those related to Personal Data, in writing or verbally or electronically.

 

3.   To whom and for what purposes do we transfer your personal data?

Your personal data will be shared by DYG with the following authorized persons and/or institutions in Turkey and abroad within the scope of the data processing conditions set out in Article 5 of the Law and in accordance with the rules regarding the transfer of personal data specified in the Law in order to achieve the above-mentioned purposes.

4.   What are our Personal Data Collection Methods and Legal Basis?

We may collect and process your Personal Data in accordance with the provisions of the Policy, the Law and the relevant legislation by written, verbal, electronic means, video/audio recording or by meeting with you face to face.

Our Personal Data Collection process; i) through digital media or software belonging to third parties including websites, mobile applications, e-mail, recruitment portals, ii) through contracts, applications, forms, call center, remote support, sales and marketing unit, website cookies, business cards, telephone, etc. or iii) through one-on-one meetings with Data Subjects.

5.   What are your rights as a data subject?

As a data subject, you have the following rights:

  • To apply to our Company as a Data Owner pursuant to Article 11 of the Law and
  • Learn whether your Personal Data is being processed,
  • Requesting information in case your Personal Data is processed,
  • To learn the purpose of processing your Personal Data and whether this data is used in line with its purposes,
  • To know the third parties to whom your Personal Data is transferred domestically or abroad,
  • To request correction of incomplete or incorrect data, if any, and to request notification of the transaction made within this scope to third parties to whom Personal Data is transferred,
  • Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of Personal Data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom Personal Data is transferred,
  • Object to your Personal Data being analyzed by automated means in a way that leads to a negative result exclusively for you,
  • In case of damage due to unlawful processing of your Personal Data, to demand compensation for the damage.
  • However, pursuant to Article 28/2 of the Law on the Protection of Personal Data, you may not exercise your rights listed above, except for the right to claim compensation in the following cases:
  • Processing of Personal Data is necessary for the prevention of crime or criminal investigation.
  • Processing is carried out on Personal Data made public by the Data Subject himself/herself.
  • Processing of Personal Data is necessary for the execution of supervisory or regulatory duties and disciplinary investigation or prosecution by authorized and authorized public institutions and organizations and professional organizations in public institutions based on the authority granted by law.
  • Personal Data processing is necessary for the protection of the economic and financial interests of the State in relation to budget, tax and financial matters.
  • You can exercise your rights by filling out and signing the application form that you can access by clicking on this link and submit your request in Turkish and in writing or by using secure electronic signature, mobile signature or your e-mail address that you have previously notified to our Company and registered in our system.
  • In case of written application, you may submit your request in Turkish and in writing by filling out and signing the application form and sending the original of the form to “Maslak Mah. Büyükdere Cad. No:249/6 34485 Sarıyer / İstanbul” address through a notary public or by hand-delivering it to the same address in person or by having it delivered through your proxy.
  • In case of application by other means mentioned above (electronically), the application form must be filled in and sent to the address below.

  • Together with the form, it is obligatory to submit to us the documents identifying your identity, the documents certifying your request, if any, and if you wish to exercise this right through a proxy, a copy of the power of attorney containing special authorization.
  • Your requests submitted with the form will be answered free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.

 

During the application; in cases such as sharing incomplete or incorrect information, not expressing the request clearly, not submitting or incomplete submission of supporting documents, not attaching a copy of the power of attorney in applications made by proxy, you may encounter difficulties in meeting your requests and this may cause delays in the examination process. Therefore, it is important that you comply with the above-mentioned issues while exercising your rights. Our company will not be responsible for any delays in such cases. All legal rights of our company are reserved in case of false, untrue/illegal and malicious applications.
